Refund & Cancellation Policy

This Refund and Cancellation Policy ("Policy") governs the terms under which you may cancel your subscription to Find The Breach services and request a refund. By subscribing to or purchasing any of our services, you agree to the terms set forth in this Policy. This Policy is incorporated into and forms part of our Terms of Service.
1 Cancellation Process
You may cancel your subscription at any time through any of the following methods:
- Self-Service: Log in to your account dashboard and navigate to Settings > Subscription > Cancel Subscription. Follow the on-screen prompts to complete the cancellation.
- Email: Send a cancellation request to contact@findthebreach.com from the email address associated with your account. Include your account name and the reason for cancellation.
Upon cancellation:
- Your subscription will remain active until the end of your current billing period. You will continue to have full access to the Service during this time.
- No additional charges will be incurred after the cancellation is processed.
- Your account data, including scan results and reports, will be retained for thirty (30) days following the end of your billing period, after which it will be permanently deleted unless you request earlier deletion.
- You may reactivate your subscription at any time during the retention period to restore access to your data.
2 Refund Eligibility
Refund eligibility depends on the subscription type and the timing of the cancellation request:
Monthly Subscriptions
Monthly subscriptions are eligible for a full refund if the cancellation request is submitted within seven (7) days of the initial subscription purchase or the most recent renewal date, provided that no scans have been initiated during the current billing period. If scans have been initiated, no refund will be issued for the current billing period.
Annual Subscriptions
Annual subscriptions are eligible for a full refund within fourteen (14) days of the initial purchase date, provided that no more than two (2) scans have been initiated. After the fourteen-day window, annual subscriptions are eligible for a pro-rata refund as described in Section 3.
Enterprise Plans
Enterprise plan refunds are governed by the terms of the individual enterprise agreement. Please contact your account representative or contact@findthebreach.com for details.
3 Pro-Rata Refunds
For annual subscriptions cancelled after the initial fourteen-day refund window, Find The Breach will issue a pro-rata refund calculated as follows:
Refund Amount = (Annual Fee / 12) x Remaining Full Months - Early Termination Fee
- "Remaining Full Months" means the number of complete calendar months remaining in the subscription term after the effective cancellation date.
- The Early Termination Fee is equal to two (2) months of the monthly equivalent subscription fee, or the remaining balance of the subscription, whichever is less.
- Pro-rata refunds are not available for monthly subscriptions.
- Any promotional discounts or credits applied to the original purchase will be factored into the refund calculation at the discounted rate.
4 Free Tier Terms
The Find The Breach free tier is provided at no cost and is subject to the following terms:
- The free tier is provided "as is" without any uptime or performance guarantees.
- Free-tier accounts are not eligible for refunds, as no payment is collected.
- Find The Breach reserves the right to modify, limit, or discontinue the free tier at any time without prior notice.
- Free-tier accounts that remain inactive for ninety (90) consecutive days may be automatically deactivated and associated data may be deleted.
- Upgrading from a free tier to a paid plan will initiate billing on the date of the upgrade, and the paid plan's refund terms will apply from that date forward.
5 Payment Disputes
If you believe you have been charged in error or have a dispute regarding any charge on your account, please contact us promptly:
- Payment disputes must be submitted within sixty (60) days of the disputed charge by contacting contact@findthebreach.com.
- Include your account information, the date and amount of the disputed charge, and a description of the dispute.
- Find The Breach will investigate the dispute and respond within ten (10) business days.
- If the dispute is resolved in your favor, a refund or credit will be issued within five (5) business days of resolution.
- We encourage you to contact us directly before initiating a chargeback with your financial institution, as we are committed to resolving disputes promptly and fairly.
6 Chargebacks
Find The Breach reserves the right to take the following actions in the event of a chargeback (payment reversal) initiated through your bank or credit card provider:
- Your account may be immediately suspended pending resolution of the chargeback.
- If a chargeback is filed for a charge that Find The Breach determines to be valid, we reserve the right to contest the chargeback and provide documentation to the payment processor supporting the validity of the charge.
- An administrative fee of up to $25.00 USD may be assessed for each chargeback that is resolved in Find The Breach's favor or withdrawn by the customer.
- Repeated or fraudulent chargebacks may result in permanent termination of your account.
- Outstanding balances resulting from chargebacks may be referred to a collections agency.
7 Refund Method and Processing
Approved refunds will be processed as follows:
- Refunds will be issued to the original payment method used for the purchase.
- Refund processing typically takes five (5) to ten (10) business days, depending on your financial institution.
- Refunds for payments made via wire transfer may take up to thirty (30) business days.
- All refunds are issued in United States Dollars (USD). Currency conversion fees, if any, are the responsibility of the customer.
8 European Union Consumer Rights
If you are a consumer located in the European Union or European Economic Area, you have a statutory right to cancel your Subscription within fourteen (14) days of purchase without giving any reason (the "Cooling-Off Period"), in accordance with the EU Consumer Rights Directive (2011/83/EU).
To exercise this right, inform us at billing@findthebreach.com with an unambiguous statement of cancellation, including your account email and order date.
Loss of Withdrawal Right: If you request that the Service begins during the Cooling-Off Period (e.g., by initiating a scan or using platform features), you acknowledge that you will lose your right of withdrawal once the Service has been fully performed. For digital content provided in a non-tangible medium, if you expressly consent to the Service beginning before the end of the Cooling-Off Period and acknowledge the loss of withdrawal right, the cooling-off period will not apply after Service performance has begun.
If the withdrawal right applies and is validly exercised, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event not later than fourteen (14) days from the day we are informed of your decision to withdraw. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
